Aims of the course:

This seminar deals with the impending and critical changes to legislation which concern every company entering into UK construction contracts. The new law takes effect from 1 October 2011 and it will immediately impact on the administration of contracts, particularly with regard to payment provisions and related issues.

This seminar will address the practical steps companies can implement to ensure compliance with the legislation and to mitigate against the financial exposure which breaches of the legislation may bring about.

Topics covered:

    • The significance of oral as well as written contracts being covered by the Construction Act.
    • The prohibition of contract terms which force a referring party to bear adjudication costs.
    • The prohibition of “Pay when Certified” contract terms and the practice of extending the payment due date by reference to the giving of notice to a receiving party.
    • The requirement for contracts to provide for the giving of a payment notice by the paying party or the receiving party.
    • New provisions for the service of “Payment Notices” and “Pay Less Notices”.
    • The enhanced right to suspend works and to recover time incurred during any suspension.
    • Amendments to the UK standard forms of contract
