Aims of the course:

This seminar deals with the imminent changes to the Construction Act which concerns every company entering into construction contracts in the UK. The new legislation is effective from 1 October 2011 and will have an immediate effect on the administration of contracts, particularly with regard to payment.

We will address the key changes brought about by the new legislation and their implications for your business.

    • The implications of adjudication applying to oral as well as written contracts
    • The requirements and effects of a Payer Notice and a Payee Notice
    • New provisions regarding Pay-Less Notices and the possible implications of failure to serve a proper notice
    • The prohibition on ‘pay when certified’ provisions and the implications on release of retention
    • New provisions concerning adjudication costs and the correction of ‘slips’
    • The enhanced rights to suspension and to recover costs
